[d at DCC] (US) Copyright or Trademark issue?

Hi all,

I came across a story from Newser today that kinda makes me shake my head.

The article claims this as a Copyright issue but strikes me as a
Trademark problem.  Would anyone mind clarifying?  (The article
doesn't cite any sources and is a little thin on information -- if it
is a Copyright issue though, it strikes as being an abuse.)
