Actually, I take the ethical comment back, because I don't really
believe it myself. The royalty model discounts the tariff for copying
of public domain works, other non-leviable works and for use of audio
recording media for other purposes, but it still problematic for two
reasons: 1) at their best, these are just guesstimates of actual use;
2) even if the model was perfectly accurate, it is based on a blended
sale data/radio airplay assessment of copied works which
discriminates against new and less successful artists, particularly
artists who are turning to new distribution models - like the
Internet - to both advertise and sell their music.
