 The question should be:  Is this a recording for personal use, or
commercial publication?  I believe that private copying/recording/etc
should become a well-protected fair-dealings right, and that this case
should be understood as a private recording.

  Anyone walking down the street should have the ability to
refuse/veto/etc the for-profit use of their image/sound/etc without
permission.
