The first article referenced below is a good summary to bring people up
to date.
The bias or misunderstanding of the issues by the New York Times writer
is showing. The final paragraph talks about some commercial for-profit
copying which is unrelated to the cases against the DMCA which are in
relation to private-copying and circumvention of fair use.
I believe the attempt to confuse private copying and fair use with
commercial copyright violation is a deliberate lobbying attempt. The same
type of deliberate confusion has been attempted throughout this
consultation process and it has been rather annoying.
